These Terms of Service ("Terms") govern the use of the website zerohunt.ai and the Zero Hunt platform, provided by Over Holding Srl, a company incorporated under the laws of Italy, with registered office at Viale Tricesimo n.200, 33100 Udine, Italy, VAT IT02945890305 (hereinafter "Zero Hunt", "we", "us", "our").

By accessing this website or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website or services.

Zero Hunt is an autonomous AI-powered cybersecurity platform that provides:

• Generative AI penetration testing
• Real-time deep-packet traffic analysis and network detection
• Continuous compliance automation across multiple regulatory frameworks

The platform is deployed on-premise within the customer's infrastructure. No customer data leaves the customer's network during platform operation.

In compliance with Regulation (EU) 2024/1689 (the AI Act), we disclose the following:

• High-risk classification: Zero Hunt's autonomous penetration testing engine is classified as a high-risk AI system under Annex III of the AI Act, given its application in critical infrastructure security assessment.
• Conformity and documentation: We maintain comprehensive technical documentation, risk management systems, quality management systems, and logging mechanisms as required by Articles 9-19 of the AI Act.
• Human oversight: The platform operates under the deployer's human-in-the-loop supervision at all times. Customers retain full control via configurable rules of engagement, scope boundaries, and immediate kill-switch functionality.
• Deployer obligations: Customers deploying Zero Hunt are responsible for ensuring its use complies with applicable laws and for maintaining appropriate human oversight as required by Art. 26 of the AI Act.
• No prohibited practices: Zero Hunt does not engage in any AI practices prohibited under Art. 5 of the AI Act. The platform does not perform social scoring, subliminal manipulation, or exploitation of vulnerabilities of individuals.

You agree to use Zero Hunt only for:

• Authorized security testing of systems you own or have explicit written permission to test.
• Compliance assessment and reporting for your own organization or as contracted by your clients.
• Defensive cybersecurity operations within your authorized scope.

Prohibited uses include: unauthorized access to third-party systems, using the platform for offensive attacks beyond agreed scope, circumventing the platform's safety controls, or any use that violates applicable laws including but not limited to the Computer Fraud and Abuse Act (USA), the Computer Misuse Act (UK), or equivalent legislation in your jurisdiction.

All intellectual property rights in the Zero Hunt platform, including software, algorithms, AI models, documentation, trademarks, and website content, are owned by Over Holding Srl or its licensors. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited license to use the platform as provided under a separate license agreement.

Assessment results, reports, and findings generated by the platform for the customer's systems are owned by the customer.

Access to the Zero Hunt platform is subject to a separate License Agreement. These Terms govern the use of this website and general interactions with Zero Hunt. Platform-specific terms, including service levels, support, and maintenance, are defined in the applicable License Agreement.

To the maximum extent permitted by applicable law:

• Zero Hunt is provided "as is". While we strive for accuracy and completeness in security assessments, we do not guarantee that the platform will identify all vulnerabilities or security issues.
• Over Holding Srl shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the platform.
• Our total aggregate liability shall not exceed the fees paid by you in the 12 months preceding the event giving rise to the claim.
• The customer is solely responsible for acting on findings and implementing remediation measures.

You agree to indemnify and hold harmless Over Holding Srl, its directors, officers, and employees from any claims, damages, or expenses arising from: (a) your use of the platform beyond the authorized scope; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) unauthorized security testing conducted using the platform.

Our processing of personal data is governed by our Privacy Policy, which complies with the General Data Protection Regulation (EU) 2016/679. Where the platform processes personal data on behalf of the customer, a Data Processing Agreement (DPA) in accordance with Art. 28 GDPR will be executed as part of the License Agreement.

These Terms are governed by and construed in accordance with the laws of Italy. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Udine, Italy, without prejudice to the consumer's right to bring proceedings in their place of domicile as provided by Regulation (EU) 1215/2012.

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by notifying existing customers. Continued use of our website or services after modifications constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the original intent.
